These General Terms and Conditions govern access to, browsing and use of the official Sybaris Hotel website, as well as the request, booking, purchase and use of the services offered by the Property, including accommodation, rooms, events, receptions, weddings, meetings, stay packages, experiences, additional services, gift cards and, where available, products offered through the Website.

Accessing the Website, browsing its pages, using the online services, submitting enquiries, requesting quotations or making reservations constitutes full knowledge and unconditional acceptance of these General Terms and Conditions, together with the Privacy Policy and Cookie Policy.

If you do not agree with any provision contained herein, you are requested not to use the Website or any of the services offered.

(hereinafter referred to as "Sybaris Hotel", the "Hotel", the "Property", the "Company" or the "Operator").

Costa Jonica Group S.r.l.s. is the legal owner of the services offered through the Website and directly manages all reservations made through the official booking channels of Sybaris Hotel.

Article 2 – Definitions

For the purposes of these Terms and Conditions:

Guest means any natural or legal person who uses the Website or requests a reservation.

Website means the official website www.sybarishotel.it and all related web pages.

Services include accommodation, rooms, suites, restaurant services, swimming pool, events, weddings, meetings, conferences, receptions, stay packages, experiences, additional services, vouchers, gift cards and any other services marketed by Sybaris Hotel.

Booking means any reservation or purchase made through the Website, by e-mail, telephone or any other officially authorised booking channel.

Article 3 – Subject of the Agreement

Sybaris Hotel provides an online information and booking platform through which Guests may:

• book rooms and accommodation;
• request quotations;
• purchase stay packages;
• reserve experiences and additional services;
• purchase vouchers, gift cards or products, where available;
• request information regarding weddings, events, meetings and receptions.

Submitting a booking request does not automatically constitute acceptance by the Hotel.

A binding agreement shall only be concluded upon written confirmation issued by Sybaris Hotel and, where required, upon receipt of the requested deposit or payment.

Article 4 – Availability of Services

The availability of services displayed on the Website is indicative only and subject to continuous updates.

Sybaris Hotel reserves the right to correct typographical errors, inaccuracies, technical malfunctions, temporary unavailability or other inadvertent errors at any time.

Should a requested service become unavailable after a booking request has been submitted, the Guest shall be informed without undue delay and may, where applicable, choose between:

• reimbursement of any amounts already paid;
• modification of the reservation;
• issuance of a voucher of equivalent value;
• rescheduling of the booked service.

Article 5 – Reservations

Reservations may be made through:

• the official Website;
• telephone;
• e-mail;
• online enquiry forms;
• any other booking channels authorised by the Property.

Sybaris Hotel may require:

• a valid credit card as a guarantee;
• full or partial advance payment;
• payment of a deposit;
• full payment before arrival;
• a valid identification document.

The Property reserves the right to refuse incomplete, fraudulent or non-compliant reservations.

Article 6 – Prices

All prices are expressed in Euro (€).

Unless otherwise specified, prices include the applicable Value Added Tax (VAT).

Any tourist tax or other mandatory local charges shall be displayed separately and paid in accordance with applicable local regulations.

Sybaris Hotel reserves the right to modify prices, offers and promotions at any time.

Confirmed reservations shall not be affected by subsequent price changes.

Obvious publication errors, typographical mistakes or system malfunctions shall not constitute binding contractual offers.

Article 7 – Payments

Payments may be made using:

• credit cards;
• debit cards;
• bank transfer;
• cash, within the limits permitted by Italian law;
• any other electronic payment methods made available by the Hotel.

For certain reservations, a pre-authorisation of the payment card may be required as a booking guarantee.

The Guest authorises Sybaris Hotel to charge any amounts due in accordance with the conditions applicable to the selected rate.

Article 8 – Amendments, Cancellations and No-Show

Amendment, cancellation and refund conditions are those applicable to the selected rate at the time of booking.

Unless otherwise specified:

• non-refundable rates are not eligible for refunds;
• flexible rates may be modified or cancelled within the deadlines stated in the booking confirmation;
• failure to arrive without prior notice ("No-Show") may result in the application of the penalties established by the booked rate.

For weddings, receptions, meetings, conferences and private events, only the conditions expressly agreed in the relevant contract shall apply.

Article 9 – Check-in and Check-out

Guests must present a valid identification document upon arrival, in accordance with Italian law.

Check-in and check-out times are those communicated by the Property or indicated in the booking confirmation.

Requests for early check-in or late check-out are subject to availability.

Sybaris Hotel reserves the right to apply additional charges for late departures.

Article 10 – Guest Obligations

Guests undertake to:

• use rooms, common areas and services responsibly;
• comply with the internal regulations of the Property;
• behave respectfully towards staff and other guests;
• safeguard their personal belongings;
• compensate the Hotel for any damage caused to rooms, furnishings, facilities or third parties;
• comply with all applicable safety rules and regulations.

Sybaris Hotel reserves the right to terminate a stay or deny access to the Property, without any obligation to provide a refund, where a Guest engages in violent, offensive, discriminatory, unlawful or otherwise inappropriate behaviour that may compromise the safety, security, comfort or peaceful enjoyment of the Property by others.

Article 11 – Limitation of Liability

Sybaris Hotel makes every reasonable effort to ensure that the information published on the Website is accurate and that the online services operate correctly.

However, the Hotel does not guarantee that the Website will always be available or free from interruptions caused by technical issues, scheduled maintenance, force majeure or circumstances beyond its reasonable control.

To the fullest extent permitted by applicable law, the Property shall not be liable for indirect damages, financial losses, loss of data, loss of profits or any damages resulting from temporary unavailability of the Website or its services.

Article 12 – Intellectual Property

All content published on the Website, including but not limited to texts, photographs, images, logos, trademarks, videos, graphics, software, layout and any other material, is the exclusive property of Costa Jonica Group S.r.l.s., Sybaris Hotel or their respective rights holders and is protected by Italian and international intellectual property laws.

No content may be reproduced, copied, modified, distributed, published or otherwise used, in whole or in part, without the prior written consent of the rights holder.

Article 13 – Privacy

The processing of personal data is governed by the Privacy Policy and Cookie Policy published on the Website and carried out in compliance with Regulation (EU) 2016/679 (GDPR) and applicable Italian legislation.

Article 14 – Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Italy.

Any dispute concerning the interpretation, validity or performance of these Terms and Conditions shall be subject to the jurisdiction of the competent Italian courts, without prejudice to the mandatory rights granted to consumers under applicable consumer protection legislation.

Article 15 – Final Provisions

Should any provision of these Terms and Conditions be declared invalid, unlawful or unenforceable, the remaining provisions shall remain fully valid and effective.

Sybaris Hotel, operated by Costa Jonica Group S.r.l.s., reserves the right to amend or update these Terms and Conditions at any time for operational, technical, organisational or legal reasons.

Any amendments shall become effective upon publication on www.sybarishotel.it and shall apply to all reservations made thereafter, unless otherwise required by applicable law.
